Terms of Use

Effective date:

About these terms

These terms are an agreement between you and Parallax Interactive, LLC (“PrllxLabs”, “we”, “us”), the maker of Bounce Party (“the game”). By downloading or playing the game you accept them. If you don't agree, please don't use the game.

If you are under 18, or under the age of majority where you live, please read these terms with a parent or guardian and make sure they agree to them. You must also meet the minimum age shown for the game in your app store. How we handle your data is explained in our Privacy Policy.

Your licence to play

We give you a personal, non-exclusive, non-transferable and revocable licence to download the game and play it on devices you own or control, for your own non-commercial use. The game is licensed to you, not sold.

Except where the law expressly allows it, you may not copy, modify, sell, rent or distribute the game, or decompile or reverse engineer it.

Your account

The game gives you an anonymous account the first time you open it. You can link it to Sign in with Apple or Sign in with Google in Settings. Your account is for you only: don't share, sell or transfer it.

Your game progress is stored on your device, not on our servers. Signing in does not copy it anywhere, and we can't restore progress that is lost with a device, a reinstall or a reset.

Coins and other virtual items

The game uses virtual coins, levels, unlocked cities and cup prizes. You get coins for free: when you start, from free coins that refill over time, from level rewards and cup prizes, from winning rounds and by choosing to watch ads.

  • Coins have no monetary value. They are not money or property, and you can't buy them, cash them out, exchange them for money or anything of value, sell them or transfer them to anyone else.
  • There are no in-app purchases in the game.
  • Coins and the other virtual items are part of your licence to play. We may change how they work, rebalance them, or correct balances that come from errors or cheating.
  • Some features take coins away as part of the game: for example, a missed call costs the coins you played, and a coin storm makes a small share of your coins leak away over time.
  • They are lost when you reset your progress, delete your account or lose the game's data on your device.

No real money

Each round is decided by the game's physics simulation and chance. You play free virtual coins and may call an outcome, but no real money is ever involved: nothing you can buy goes in and nothing of real-world value comes out. The game offers no way to play for real money or to win money or prizes, and how you do in it says nothing about any game played for money.

Cups and rivals

The daily cup and the sprint cups give their prizes in virtual coins only. Rivals in the cups are simulated by the game and marked as such. Standings, prizes and rules may change as the game changes.

Ads

The game shows video ads: rewarded videos you choose to watch, for example for bonus coins or a faster speed, and full-screen videos between rounds or when you go back to the lobby. Ads are provided by Google AdMob; we don't control their content and aren't responsible for the products or websites they promote.

Ads aren't always available. If no ad can be shown, or one doesn't finish, the reward may not be given. Your ad and privacy choices are explained in our Privacy Policy.

Playing fair

When you play, please don't:

  • cheat, or use bots, hacks, modified versions of the game or tools that give you an unfair advantage;
  • exploit bugs (please tell us about them instead);
  • interfere with the game or its services, or try to access accounts or data that aren't yours;
  • use the game for anything illegal.

We may suspend or close an account that breaks these rules. Where possible and appropriate, we will tell you why.

Deleting your account

You can delete your account at any time in the game, from Settings → Account → Delete account, or by email. Deleting your account also resets your progress on that device; we can't restore it afterwards. You can also simply stop playing.

Changes and availability

We keep working on the game. We may add, change or remove cities, games, cups and other features, and we may need to pause services for maintenance. We don't promise that the game will always be available or free of errors. Some features, such as sign-in and ads, need an internet connection.

We may stop offering the game. If we do, we will try to give you reasonable notice in the game or on this website.

Our content

The game, its name, art, music, sounds and code belong to us or to our licensors and are protected by intellectual property laws. Some parts are open-source software or fonts used under their own licences; see our third-party notices.

Disclaimers

The game is free and provided “as is” and “as available”, to the extent the law allows. We do our best to make it work well, but we can't guarantee that it will be uninterrupted or error-free, or that your progress will never be lost.

Nothing in these terms limits your rights as a consumer under the law that applies to you, including any legal guarantee of conformity for digital content.

Limitation of liability

To the extent the law allows, we are not liable for indirect or unforeseeable losses, or for losses that come from events outside our reasonable control, from your breach of these terms, or from third-party services such as app stores, sign-in providers and ad networks.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that cannot be excluded or limited by law.

If you got the game from the App Store

If you downloaded Bounce Party from Apple's App Store, these extra terms apply:

  • These terms are between you and us, not Apple. We, not Apple, are solely responsible for the game and its content.
  • Your use of the game is also governed by Apple's Licensed Application End User License Agreement (the standard EULA), which applies alongside these terms, and by the usage rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide any maintenance or support for the game.
  • If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the game. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility.
  • We, not Apple, are responsible for addressing any claims relating to the game or your use of it, including product liability claims, claims that the game fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the game or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when you use the game, such as your mobile data agreement.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple will have the right to enforce them against you as a third-party beneficiary.

Questions, complaints or claims about the game should be sent to us: Parallax Interactive, LLC, 12100 Wilshire Blvd Ste 800 PMB 17071305, Los Angeles, CA 90025-7140, United States, help@prllxlabs.com.

If you got the game from Google Play

If you downloaded Bounce Party from Google Play, the Google Play Terms of Service also apply to your use of Google Play. These terms are between you and us, not Google, and Google is not responsible for the game.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute that is not resolved with us first will be decided by the state or federal courts located in Delaware, except where the mandatory rules described below give you the right to go to the courts where you live.

If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim in the courts there. If you have a problem with the game, please contact us first; most issues can be solved quickly by email.

Changes to these terms

We may update these terms when the game or the law changes. The effective date at the top always shows the current version. If a change is important, we will tell you in the game or on this website before it applies. If you keep playing after that, the new terms apply; if you don't agree, you can stop playing and delete your account.

If any part of these terms turns out to be invalid, the rest still applies.
